1. Who we are

cairnity ltd ("Cairnity", "we", "us") is a specialist hospitality recruitment business registered in Scotland, Company No. SC892394. Our registered office is at BBKS & Co, N Deeside Rd, Banchory AB31 5YR. We are the data controller for the personal data described in this notice. 2. Who this notice covers

Candidates and relief workers we introduce or consider introducing to clients; client contacts at the businesses we serve; referees who provide references; and visitors to this website (see also our Cookie Policy).

3. Information we collect

Candidates and relief workers: identity and contact details; career information including CV, work history, qualifications, salary expectations and availability; evidence of identity and eligibility to work in the UK where provided; references and verification outcomes; records of our communications, interview and placement notes, and client feedback; and special category data (for example health or disability information) only where you volunteer it or it is necessary to arrange reasonable adjustments, with your explicit consent or as permitted by employment law.

Client contacts and referees: business contact details, records of communications, role requirements, contractual and billing information, and the content of any reference given.

4. How we obtain information

Directly from you; from referees you nominate; from clients (for example interview feedback); from publicly available professional sources such as LinkedIn; and through your use of this website.

5. How we use information and our lawful bases

  1. Providing recruitment services — assessing suitability, making introductions, arranging interviews and placements. Lawful bases: our legitimate interests in operating a recruitment business, and steps taken at your request prior to entering a contract.
  2. Verification — confirming identity, experience and qualifications as required by the Conduct of Employment Agencies and Employment Businesses Regulations 2003. Lawful basis: legal obligation.
  3. Client relationship management — managing engagements, invoicing and business records. Lawful bases: performance of a contract and legitimate interests.
  4. Marketing — contacting business contacts about our services. Lawful basis: legitimate interests; opt out at any time via ian@cairnity.co.uk.
  5. Legal compliance — recruitment records under the Conduct Regulations and financial records required by HMRC. Lawful basis: legal obligation.
  6. Special category data — processed only with explicit consent or where necessary for obligations under employment law (Article 9 UK GDPR; Schedule 1 DPA 2018).

6. Who we share information with

Prospective employers — candidate details only for a specific introduction, and only where the candidate is aware of and willing to be considered for the role. Service providers — CRM, email and IT providers and our accountants, under contracts requiring them to protect your data. Professional advisers where necessary. We do not sell personal data.

7. International transfers

Some service providers may store or process data outside the UK. Where they do, appropriate safeguards are in place, such as UK adequacy regulations or the UK International Data Transfer Agreement.

8. How long we keep information

Candidate and relief worker records: the duration of our relationship and 2 years from last meaningful contact, unless you ask us to delete them sooner or consent to longer; the Conduct Regulations require recruitment records to be kept for at least 1 year. Client records: the duration of the relationship plus 5 years, in line with Scots law prescription periods. Financial and tax records: 6 years plus the current year. Data no longer required is securely deleted or anonymised.

9. Your rights

You have the right to access your personal data; to have inaccurate data corrected; to erasure in certain circumstances; to restrict or object to processing; to data portability; and to withdraw consent at any time where processing is based on consent. To exercise any right, email ian@cairnity.co.uk; we will respond within one month.

10. Complaints

Please contact us first and we will do our best to resolve any concern. You also have the right to complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.
